The Potentially Costly Disadvantages Of Failing To Document Patient Safety Issues

A Florida nursing home, Boca Raton Rehabilitation Center, was sued for wrongful termination by a former nurse, who alleged she was fired after reporting patient neglect.

The nurse, Nuella Joseph, was hired in January 2025 as a medical records coordinator. Joseph alleges that shortly after she was hired, she helped a 62-year-old patient take what she claims was his first shower in weeks.

During that time, Joseph claimed she noticed that the patient's clothes were stuck to his body. She allegedly was only able to remove them by cutting them off.

Once the patient's skin was visible, Joseph claimed she saw maggot-infested sores on his body. She contacted leadership about this issue and was instructed not to take photographs. The director of nursing at the facility allegedly told the patient that maggots would be "good for his wounds" because they would eat the dead tissue in his wound, asking the patient, "have you ever heard of Maggots Therapy, sir?"

Joseph alleges that in this instance, the presence of maggots was not connected to a controlled or intentional medical treatment utilizing maggots to clean wounds. Joseph alleges the infestation was the result of neglect and failure to help the patient maintain proper hygiene.

The patient allegedly continued to suffer after this incident.

Further, Joseph claims her reports were not documented, including her request to transfer the patient to a hospital.

Prior to her termination, Joseph allegedly also reported mold, termites, and roach infestations at the facility. She claims these reports also were not taken seriously or documented.

In the above case, allegations included failure to document reports about patient care and conditions at the facility.

In healthcare settings, an industry driven by documentation, the absence of a documentation record is viewed in a negative light, especially by juries and those that may evaluate patient safety issues.

When a patient's condition worsens and no documentation exists outlining staff response or follow up, courts and juries often infer that no meaningful response occurred, even if the matter was discussed privately without being documented.

Healthcare organizations may rely heavily on contemporaneous records showing what occurred, what was reported, to whom, how it was evaluated, and what measures were taken to address the matter when defending against claims of negligence or wrongful death. In the absence of that documentation trail, organizations may rely on witness memory, which is highly questioned for accuracy.

This is also true for employment practice-related claims. If an employee reported concerns that were never documented and that employee later claims wrongful termination, a lack of documentation may support an inference that the employee's complaints were part of the termination decision.

Healthcare organizations may help avoid the risks by documenting all reports received, including what action was taken to resolve them, even if that action is simply stating that the report was unfounded.
